Contractor’s Certification.
By submitting an offer, the contractor certifies that the product offered meets the specific salient characteristics of this CID; conforms to the producer’s own specifications and standards, including product characteristics, manufacturing procedures, quality control procedures, and storage and handling practices; has a national or regional distribution from storage facilities located within the United States, its territories, or possessions; and is sold on the commercial market. The Government reserves the right to determine proof of such conformance prior to first delivery from point of origin and any time thereafter, up to an including delivery at final destination, as may be necessary to determine conformance with the provisions of the contract.
Regulatory Requirements.
The delivered product shall comply with all applicable Federal and State mandatory requirements and regulation relating to the preparation, packaging, labeling, storage, distribution, and sales of the product in the commercial marketplace.
The product shall comply with all regulations pursuant to the provisions of the following Acts:
1. Food, Drug, and Cosmetic Act (21 CFB Parts 1 to 199).
2. Infant Formula Act of 1980.
Preservation, Packaging, Packing, Labeling, and Marking (as appropriate and applicable).
The product shall be preserved, packaged, and labeled in accordance with good commercial practice and packed in fiberboard boxes that will assure acceptance by common carrier and provide product protection against loss and damage during multiple shipments, handling, and storage. Shipping containers shall comply with National Motor Freight or Uniform Freight Classification, as applicable.
Each pound container shall include a measuring scoop and be equipped with a plastic lid for use after opening.
Notes.
- Purchaser shall specify labeling requirements, if different from good type of commercial practice.
- Purchaser shall specify milk-based powdered infant formula.
- Purchaser shall specify container pack and packaging size.
- Purchaser shall specify if the product is to be processed in a plant approved by the Dairy Grading Branch, Dairy Division, Agricultural Marketing Service, U.S. Department of Agriculture (USDA).
