Contractor’s certification.
By submitting an offer, the contractor certifies that the product offered meets the specified salient characteristics of this Commercial Item Description; conforms to the producer’s own specifications and standards, including product characteristics, manufacturing procedures, quality control procedures, and storage and handling practices, has a national or regional distribution from storage facilities located within the United States, its territories, or possessions. The Government reserves the right to determine proof of such conformance prior to the first delivery from point of origin and any time thereafter, up to and including delivery at final destination, as may be necessary to determine conformance to the provisions of the contract.
Regulatory requirements.
The delivered product shall comply with all applicable Federal and State mandatory requirements and regulations relating to the preparation, packaging, labeling, storage, distribution, and sales of the product in the commercial marketplace.
The product shall comply with all regulation (21 CFR Parts 1 to 199) pursuant to the provisions of the Federal Food, Drug, and Cosmetic Act and the Infant Formula Act of 1980 as determined by the Food and Drug Administration.
Quality assurance.
Prior to submission of offers, plants shall be approved by the Dairy Grading Section, Dairy Division, Agricultural Marketing Service, USDA. Infant formula shall be manufactured only in such approved plants. All dairy products used as ingredients shall originate from an approved plant, except the vitamin folacin may be of domestic or foreign production. Exceptions for any ingredients to be used, other than folacin, must be approved in writing by the Dairy Division, USDA.
Examination of containers shall be in accordance with the United States Standards for Condition of Food Containers currently in effect on the date of solicitation and in accordance with the requirements in the applicable regulations.
Preservation, packaging, packing, labeling, and marking.
The product shall be preserved, packaged, and labeled in accordance with good commercial practice and packed in fiberboard boxes that will assure acceptance by common carrier and provide product protection against loss and damage during multiple shipment, handling, and storage. Shipping containers shall comply with the National Motor Freight Classification or the Uniform Freight Classification, as applicable. Each can of powder Infant formula shall include a measuring scoop and be equipped with a plastic lid for use after opening.
